Welcome to Empathease! By accessing or using our mobile application, Empathease (“we,” “us,” “our”), you agree to be bound by these Terms of Service (“Terms”). Please read them carefully. If you do not agree with these Terms, please do not use Empathease.

Empathease is a service provided by Blockchain Solutions LLC, a company registered in Utah, USA. We may update these Terms at any time, and we will notify you of significant changes. Continued use of the app following any modifications constitutes acceptance of the new Terms.

2. Description of Services

Empathease is a mobile application designed to help users develop empathetic communication skills through AI-driven exercises and training. Access to certain features may require a subscription, and users must be at least 13 years old to create an account and use the app.

3. User Account and Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Account-sharing or impersonation of others is prohibited. If you suspect unauthorized access, please notify us immediately.

4. Acceptable Use Policy

You agree not to misuse the app, including but not limited to:

• Harassing, threatening, or impersonating others.
• Attempting to reverse-engineer, interfere with, or disrupt the app's functionality.
• Using the app in a way that violates any applicable laws or regulations.

We reserve the right to terminate accounts that violate this Acceptable Use Policy.

5. Payments and Subscriptions

Empathease operates on a subscription model. By subscribing, you agree to pay the subscription fees as specified at the time of purchase. Subscriptions may be billed monthly or yearly.

• Monthly Subscriptions: You may cancel your monthly subscription at any time. After cancellation, you retain access to paid features until the end of the current billing cycle, after which your access will revert to free features.
• Yearly Subscriptions: If you cancel a yearly subscription, you retain access to paid features until the end of the current subscription year, after which your access will revert to free features. No prorated refunds will be issued for unused portions of the subscription period.

6. Intellectual Property

Empathease, including its AI models, content, and branding, is the intellectual property of Empathease. You are granted a limited, non-transferable license to use the app for personal, non-commercial purposes. Any unauthorized use or reproduction of Empathease's content is prohibited.

7. User-Generated Content

Users retain ownership of their personal data and input, but by using Empathease, you grant us a license to use anonymized data to improve our AI models and enhance the app. Inappropriate content may be removed, and we reserve the right to terminate accounts associated with violations.

8. Disclaimer of Warranties

Empathease is provided “as-is” without any warranties, express or implied. While we strive to help users improve empathetic communication, results may vary, and we cannot guarantee specific outcomes. Use the app at your own discretion and risk.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Empathease shall not be liable for any damages arising from the use or inability to use the app, including, but not limited to, direct, indirect, incidental, special, or consequential damages.

10. Indemnification

You agree to indemnify and hold harmless Blockchain Solutions LLC from any claims, damages, losses, liabilities, costs, and expenses arising from your misuse of the app or violation of these Terms.

11. Termination of Use

We reserve the right to suspend or terminate your access to Empathease at any time for violating these Terms or if your use poses a security risk.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Utah, without regard to conflict of law principles. In the event of a dispute arising from or relating to these Terms or your use of Empathease, you agree to resolve it through binding arbitration in Utah, USA, rather than through court litigation. You waive your right to participate in any class action or similar proceeding. The arbitration shall be conducted under the rules of the American Arbitration Association, and judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction.

13. Changes to the Terms of Service

Blockchain Solutions LLC reserves the right to modify these Terms at any time. We will notify you of significant changes, and your continued use of the app following any updates constitutes acceptance of the revised Terms.
